The Net Investment Income (NII) Tax applies to certain net investment income of individuals, estates and trusts that have income above the statutory threshold amounts at a rate of 3.8%. The NII Tax was effective beginning on or after January 1, 2013. Individuals who are subject to the NII Tax have modified adjusted gross income over thresholds which are not indexed for inflation.
